This Privacy Policy (the “Policy”) sets out how personal data of visitors to the website tobe.restaurant (the “Website”), operated by “To be” restaurant (“Restaurant”, “we”), is collected, processed, stored, and protected.

The Website does not have forms (reservation, contact, or newsletter forms) that submit your data directly to the Restaurant’s server. Visitor interactions happen through the following channels:

  • Phone call – to book a table you call the number listed on the Website; the call itself is not processed or stored by the Website.
  • Instagram Direct – an alternative way to make a reservation; messages and personal data are processed on the Instagram platform (Meta Platforms) under its own privacy policy.
  • Telegram channel – subscribing to news is done by voluntarily joining a Telegram channel; data is processed by Telegram.
  • ChoiceQR delivery service – placing a delivery order happens on the third-party ChoiceQR service, which processes the data you enter under its own policy.
  • Technical data – IP address, browser and device type, page-browsing data – collected automatically via cookies and the analytics tools Google Analytics and Meta Pixel installed on the Website.

4. Purpose of Processing

  • analysing traffic and improving the Website;
  • ensuring the technical operation of embedded Website elements (map, links to third-party services);
  • displaying relevant content on social media via Meta Pixel;
  • complying with applicable law.

Data related to the reservation itself, delivery orders, or the newsletter is processed by the respective third-party services (Instagram, ChoiceQR, Telegram) under their own policies – the Restaurant does not keep its own database of this data.

5. Legal Basis and Consent

Processing of technical data via cookies is based on:

  • the consent of the Website visitor, given through the cookie banner;
  • the Restaurant’s legitimate interests (analysing Website traffic);
  • requirements of Ukrainian law, including the Law of Ukraine “On Personal Data Protection”.

6. Data Retention Period

Technical data collected via cookies is retained according to the periods set out in the Cookie Policy. Data is deleted or anonymised once it is no longer needed for the purpose it was collected for.

7. Disclosure to Third Parties

We do not sell personal data to third parties. Data may be processed by:

  • the Website’s hosting provider – Ukraine.com.ua; the provider’s servers may be located in Ukraine, Germany, France, Poland, or the USA depending on the hosting plan;
  • the ChoiceQR online ordering and delivery service – when you use the relevant section of the Website;
  • Instagram (Meta Platforms) – when booking via Direct;
  • Telegram – when subscribing to the news channel;
  • Google Analytics, Meta Pixel, and Google Maps – under their respective privacy policies;
  • government authorities – in cases expressly provided for by law.

You have the right to:

  • obtain information about which of your data is being processed;
  • request correction of inaccurate data;
  • withdraw previously given consent (e.g., via cookie settings);
  • request deletion of your personal data;
  • file a complaint with the Ukrainian Parliament Commissioner for Human Rights, the authority responsible for oversight of personal data protection legislation in Ukraine.
